7. RECEIVE YOUR IMMIGRATION DECISION AND NEXT STEPS
What happens next?
The Immigration Department will make a decision about whether or not to grant you Non-refoulement Protection in Hong Kong.
Your Duty Lawyer or Pilot Scheme Lawyer should call you to tell you when the Immigration Department has made its decision.
Your Duty Lawyer or Pilot Scheme Lawyer should explain the decision to you, so that you can understand the reason the decision was made.
If your claim is successful, you will be granted Non-refoulement Protection. This means that you will not be returned to your home country. You may be able to apply to move to another country. Your Duty Lawyer or Pilot Scheme Lawyer should explain this to you.
If your claim is refused and you do not agree with the decision, you can appeal to the Torture Claims Appeal Board / Non-refoulement Claims Petition Office. You must appeal within 14 days after notice of the decision was given. Your Duty Lawyer or Pilot Scheme Lawyer may help you to file your appeal. If your Duty Lawyer or Pilot Scheme Lawyer will not help you with this, ASK may be able to provide information about how to appeal.
