PREPARE AND SUBMIT A NON-REFOULEMENT CLAIM FORM AND RELEVANT DOCUMENTS
If you are referred to the Duty Lawyer Service, you will have a lawyer appointed to you at no cost to you.
Your Court-appointed Duty Lawyer will help you prepare and submit your Non-Refoulement Claim form t and will discuss with you other documents that might support your case.
There are three main reasons for requesting non-refoulement protection:
1. You are afraid of persecution in your country of origin because of race, religion, nationality, political opinion, or membership of a social group (for example, because of your sexual orientation).
2. You are afraid of torture or cruel, inhuman, or degrading treatment in your country of origin.
3. You are afraid of being killed or having your fundamental human rights violated in your country of origin.
You must also show that your country's government cannot or will not protect you, and that it is neither safe nor realistic for you to move to another part of your country.
If you have a partner or children who are also applying for Non-Refoulement protection, make sure that the risks each of you faces are included in your Non-Refoulement Claim form. Each person may face different risks specific to them (for example, due to their age, vulnerability, state of health, trauma, harmful traditional practices, etc.).
